Under the Arbitration Act of Thailand, there is no provision granting the arbitral tribunal the authority to order the losing party to reimburse the winning party for expenses incurred.
Although some arbitrators personally hold the view that such authority exists, arbitral tribunals have never ordered the losing party to compensate the winning party for such expenses.
