The owner of a condominium unit is not permitted to rent out the unit on a daily basis, as this would be in violation of the Hotel Act under Thai law.
This is because the registration of a condominium building differs from the registration of a hotel, in terms of the condominium regulations versus hotel accommodation rules, the use of common areas in a condominium versus those in a hotel, as well as security arrangements in a condominium compared to a hotel. In particular, residents in a condominium usually stay for a long period of time, whereas hotel guests generally stay only for short durations, such as 1–2 days or about a week. Very few hotel guests stay longer than that. This creates a significant distinction.
However, Thai law permits condominium owners to rent out their units on a monthly basis, since this differs in nature from hotel-type accommodation.
