The Judge does not directly record the witness’s testimony in Court. Instead, the Judge summarizes only the parts of the testimony deemed important and records them using an audio recording device. The recorded audio is sent to the court clerk who transcribes it. Then the Judge will read
the transcript to the witness and the relevant parties. Once, both Plaintiff and Defendant as well as witness confirm its accuracy, they will sign the testimony form.
In some cases, the Judge may record the entire witness’s testimony and might transcribe it into written form later. For in stance, Patent Case, involving inventions, where every word of the testimony is considered important.
